Brand Deal

A paid partnership between a brand and a creator where the creator produces content featuring the brand.

In short

A brand deal is a paid partnership in which a brand compensates a creator, in cash or free product or both, to produce content that promotes the brand. It is the casual industry term for a sponsored-content contract and spans everything from a single Instagram Reel to a multi-month brand-ambassador agreement. A well-structured brand deal specifies deliverables (count, format, platform), content guidelines, the approval process, usage rights, exclusivity terms, the payment schedule, and the disclosure requirement. Price is built from the creator’s published rate card, then moved by usage rights, exclusivity, urgency, and niche premiums, which together can multiply a base rate by 1.5x to 4x. In the EU a written contract is mandatory above €1,000 ex-VAT under France’s Loi 2023-451 and Décret 2025-1137, and disclosure is required under FTC 16 CFR §255.5 (US), the ASA/CAP Code (UK), UWG §5a (Germany), RD 444/2024 (Spain), and AGCom Delibera 197/25/CONS (Italy).

Brand deal is the casual industry term for what a contract would call a "sponsored content partnership". It covers the full spectrum from one-off Instagram posts to multi-month exclusive brand-ambassador contracts. The defining feature is that the brand pays the creator in cash, product, or both, in exchange for content that promotes the brand.

A well-structured brand deal specifies: deliverables (count + format + platform), content guidelines (do’s and don’ts, hashtags, mentions), approval process, usage rights, exclusivity terms, payment schedule, and FTC/ASA disclosure requirements.

In practice, brands compose a brand deal from the creator’s published rate card and then negotiate the variables that move price: usage rights, exclusivity, urgency, and niche premiums, which together can multiply a base rate by 1.5x to 4x. Creators read the incoming brief as a signal of how the partnership will go: a deal that arrives with deliverables, fee, usage rights, and disclosure rules pre-specified almost always closes faster than a vague "let’s collab" DM. In the EU, a written contract is mandatory above €1,000 ex-VAT under France’s Loi 2023-451 and Décret 2025-1137, and the disclosure clause belongs in the brief from the first draft, not in a legal review at the end.

A worked example at 2026 European rates: a first-time DTC brand books three micro creators (10K-100K followers) at €350-€1,500 per Instagram Reel each, spending €1,500-€3,000 total instead of a single €3,000 macro deal. Three data points beat one, and the micro-tier conversion-rate-to-cost ratio outperforms macro roughly 3:1 on first-purchase tracked sales, which is why most European brand deals in this budget bracket start at micro tier and scale up only after product-audience fit is confirmed.

Every Collabios booking falls under the brand-deal umbrella: the marketplace pulls together pricing, deliverable count, and payment terms so brand and creator start a partnership with the major contract terms already on the table.

Frequently asked questions

What should a brand deal contract include?

At minimum: deliverables (count, format, platform), content guidelines, the approval and revision process, usage rights, exclusivity terms, the payment schedule, and the disclosure requirement (#ad or a platform-native Paid Partnership label). In the EU, any deal above €1,000 ex-VAT requires a written contract under France’s Loi 2023-451 and Décret 2025-1137.

How much does a brand deal cost in 2026?

European working bands per Instagram Reel: nano (1K-10K followers) €80-€350, micro (10K-100K) €350-€1,500, mid-tier (100K-500K) €1,500-€5,000, macro (500K-1M) €5,000-€15,000. Usage rights, exclusivity, urgency, and niche premiums can multiply the base by 1.5x to 4x.

Does gifted product count as a brand deal?

Yes, when a post is expected in return. A gifted partnership is a contract with product as the consideration instead of cash, and it triggers the same FTC and EU disclosure obligations as a paid deal. Pure seeding with no posting expectation attached is not a brand deal and carries no disclosure duty.
